1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of the Twisted Cirque website (www.twistedcirque.co.za), mobile application and all services offered by Twisted Cirque (Pty) Ltd ("Twisted Cirque", "we", "us" or "our").
By accessing our website, downloading our application, booking a class or enrolling yourself or a minor in any Twisted Cirque programme, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you should not use our services.
These Terms constitute a binding agreement between you and Twisted Cirque and are governed by the laws of the Republic of South Africa.

Twisted Cirque (Pty) Ltd is a professional aerial arts academy registered in South Africa, operating studios at the following locations:

3. Eligibility and Enrolment

Twisted Cirque offers aerial arts classes for children and adults of all experience levels. The following conditions apply to enrolment:

Students under the age of 18 must have the written consent of a parent or legal guardian prior to participating in any class or programme.

By enrolling a minor, the parent or guardian confirms they have full legal authority to do so and accepts these Terms on behalf of the minor.

Twisted Cirque reserves the right to refuse enrolment to any individual where it deems participation may pose a risk to the safety of that individual or others.

Students are required to disclose any relevant medical conditions, injuries or physical limitations prior to commencing classes. Failure to do so may result in immediate suspension from the programme.
4. Class Bookings and Scheduling

4.1 How to Book
All class bookings are made exclusively through the Twisted Cirque mobile application. The website does not process bookings directly. Bookings are confirmed only upon receipt of full payment through the app.
4.2 Class Availability
Classes are subject to availability and minimum student numbers. Twisted Cirque reserves the right to cancel or reschedule a class where minimum numbers are not met or in circumstances beyond our control. In the event of a cancellation by Twisted Cirque, affected students will receive a class credit to be used within the validity period of their current package.
4.3 Punctuality
Students are required to arrive at least 10 minutes before the scheduled start of their class. Late arrivals may not be permitted to join a class in progress for safety reasons. Late arrivals will forfeit the class without credit or refund.
4.4 Waitlists
Where a class is fully booked, students may join a waitlist through the app. Waitlist placement does not guarantee a spot. Students will be notified via the app if a space becomes available.
5. Payments, Packages and Subscriptions
5.1 Pricing
All pricing is displayed in South African Rand (ZAR) and is inclusive of VAT where applicable. Twisted Cirque reserves the right to adjust pricing at any time. Updated pricing will be communicated through the app and website prior to taking effect.
5.2 Payment Methods
Payment is processed through the Twisted Cirque mobile application. Accepted payment methods are displayed within the app at the time of checkout.
5.3 Subscriptions
Where a subscription plan is selected, payment will be deducted automatically on the billing date each month. Subscriptions continue until cancelled by the student through the app. Twisted Cirque does not offer pro-rata refunds for partial months where a subscription is cancelled mid-cycle.
5.4 Package Validity
Class packages have a validity period from the date of purchase, as specified at the time of purchase in the app. Classes not used within the validity period will expire and will not be carried over, refunded or exchanged.

6. Cancellations, Rescheduling and Refunds
​
6.1 Student Cancellations
Students may cancel or reschedule a booked class through the Twisted Cirque app subject to the following notice requirements:

Cancellations made more than 24 hours before the class start time: a full class credit will be returned to the student's account.

Cancellations made less than 24 hours before the class start time: the class will be forfeited with no credit or refund.
-
No-shows (failure to attend without cancellation): the class will be forfeited with no credit or refund.
6.2 Refund Policy
Twisted Cirque operates a strict no-refund policy. All sales of class packages, subscriptions and individual bookings are final. No cash refunds will be issued under any circumstances, including but not limited to change of mind, personal schedule changes, relocation or medical reasons.
Where a student is unable to attend classes due to a medical condition, a class credit may be considered at the sole discretion of management upon submission of a valid medical certificate. This does not constitute an obligation to issue a credit and will be assessed on a case-by-case basis.
All credit requests must be submitted in writing to info@twistedcirque.co.za.
6.3 Twisted Cirque Cancellations
In the event that Twisted Cirque cancels a class due to unforeseen circumstances including but not limited to instructor illness, load shedding, facility unavailability or force majeure events, affected students will receive a class credit to their account. No cash refunds will be issued under any circumstances.

7. Health, Safety and Student Conduct
​
7.1 Health Declarations
By booking a class, you confirm that you (or the minor in your care) are in good physical health and are not aware of any condition that would make participation in aerial arts dangerous or inadvisable. You agree to inform Twisted Cirque immediately of any change in health status that may affect safe participation.
Twisted Cirque reserves the right to refuse participation to any student who appears to be unwell, injured or otherwise unfit to train safely on the day of a class.
7.2 Attire and Equipment
Students must wear appropriate, form-fitting athletic clothing to all classes. Loose clothing, jewellery are not permitted for safety reasons. Twisted Cirque provides all aerial apparatus and equipment.
7.3 Code of Conduct
Twisted Cirque is committed to maintaining a safe, inclusive and respectful environment for all students, staff and visitors. The following conduct is not tolerated:

Bullying, harassment or discrimination of any kind

Use of abusive, offensive or threatening language

Reckless or unsafe behaviour on or around aerial apparatus

Attending class under the influence of alcohol or any substance
Twisted Cirque reserves the right to remove any student from a class or suspend or terminate their enrolment without refund where conduct is deemed unacceptable.
7.4 Supervision of Minors
While minors are in class, they are under the supervision of Twisted Cirque instructors. Parents and guardians may observe classes from designated areas only and may not interfere with the instruction or coaching of any student during a session.

8. Indemnity and Limitation of Liability
​
8.1 Assumption of Risk
Aerial arts activities involve inherent and significant physical risk, including the risk of serious injury or death. By enrolling in any Twisted Cirque class or programme, you expressly acknowledge that you are fully aware of these risks, that you have had the opportunity to ask questions about the nature of the activities, and that your participation is entirely voluntary.
You confirm that neither you nor the minor in your care has been pressured or induced to participate and that you freely accept all risks associated with aerial arts training.
8.2 Full Indemnity
By enrolling in any Twisted Cirque class, programme or event, you — and where applicable, the parent or legal guardian of a minor student — agree to fully and unconditionally indemnify, defend and hold harmless Twisted Cirque (Pty) Ltd, its directors, shareholders, employees, independent contractors, instructors and agents (collectively referred to as the Indemnified Parties) from and against any and all claims, demands, actions, losses, damages, injuries, costs, expenses and legal fees of any nature whatsoever, arising directly or indirectly from:

Any bodily injury, illness, disability or death sustained by you or your child during participation in any Twisted Cirque class, event or activity, or while on Twisted Cirque premises.

Any loss of or damage to personal property brought onto Twisted Cirque premises.
-
Any pre-existing medical condition, injury or health issue not disclosed to Twisted Cirque prior to participation.
-
Any failure to follow the safety instructions, rules or guidance of Twisted Cirque instructors or staff.

Any actions or omissions of the student that contribute to injury or damage to themselves or others.
This indemnity applies even where the loss, injury or damage arises from the ordinary negligence of the Indemnified Parties, and shall only not apply in cases of gross negligence or wilful misconduct directly attributable to Twisted Cirque.
This indemnity is intended to be as broad and inclusive as permitted by South African law and shall survive the termination of your enrolment or relationship with Twisted Cirque.
8.3 Limitation of Liability
Twisted Cirque's total liability to you in respect of any claim arising from these Terms or your use of our services shall not exceed the total amount paid by you for the class or package to which the claim directly relates.
Twisted Cirque shall not be liable for any indirect, consequential, special or punitive damages arising from your use of our services or website.
8.4 Emergency Medical Treatment
In the event of a medical emergency involving a student, Twisted Cirque staff are authorised to seek emergency medical assistance on behalf of the student. Any costs arising from emergency medical treatment are the sole responsibility of the student or their parent or guardian.

9. Photography, Video and Media
​
Twisted Cirque may photograph or video students during classes and performances for use on our website, social media platforms and marketing materials. By enrolling, you consent to this use unless you specifically notify us otherwise in writing.
Where a student is a minor, consent must be provided in writing by the parent or legal guardian. This consent may be withdrawn at any time by contacting info@twistedcirque.co.za.
Students and visitors may not photograph or film other students without the express consent of those individuals and, in the case of minors, their parent or guardian.

10. Intellectual Property
​
All content on the Twisted Cirque website and mobile application — including text, images, video, logos, class materials and choreography — is the intellectual property of Twisted Cirque (Pty) Ltd or is used with the permission of the relevant rights holder.
You may not reproduce, distribute, modify, publish or use any content from our website or app for commercial purposes without our prior written consent. Unauthorised use of our intellectual property may result in legal action.

11. Website and App Use
​
You agree to use the Twisted Cirque website and mobile application for lawful purposes only. You must not:

Attempt to gain unauthorised access to any part of our website, app or systems

Use automated tools to scrape, copy or extract content from our platforms

Transmit any malicious code, spam or harmful content through our platforms
-
Misrepresent your identity or impersonate any person when using our services
Twisted Cirque reserves the right to suspend or terminate access to the website or app for any user who violates these Terms.
12. Third Party Links and Services
Our website and app may contain links to third-party websites and services, including payment processors, social media platforms and affiliate partners. These links are provided for convenience only. Twisted Cirque does not endorse or take responsibility for the content, privacy practices or terms of any third-party site or service.

13. Changes to These Terms
​
Twisted Cirque reserves the right to update or amend these Terms at any time. Updated Terms will be published on our website and app with the revised date indicated. Your continued use of our services following any update constitutes your acceptance of the revised Terms.
We recommend reviewing these Terms periodically to stay informed of any changes.

14. Governing Law and Disputes
​
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
In the event of a dispute, Twisted Cirque encourages parties to first attempt resolution through direct communication. Unresolved disputes may be referred to mediation or arbitration before litigation is pursued.

15. Consumer Protection Act
​
Nothing in these Terms is intended to limit or exclude any rights you may have under the Consumer Protection Act, 68 of 2008 (CPA) or any other applicable South African consumer legislation. Where any provision of these Terms conflicts with the CPA, the CPA shall prevail to the extent of that conflict.
